Environmental Awareness and Regulations

The overall increase in environmental awareness, particularly in the handling and transportation of hazardous materials, has had an effect in work places throughout the world. We all recognize the increasing vigilance of regulatory agencies and the heightening awareness of the work force and general public.

The Canadian Transportation of Dangerous Goods Regulations apply to the handling, shipping, transporting and importing of dangerous goods throughout Canada by any mode of transport.

The U.S. Hazardous Materials Regulations (49 CFR) cover the transportation of dangerous goods in the United States.

The International Maritime Organization (IMO) has issued the International Maritime Dangerous Goods Code (IMDG Code) which is used in both Canada and the United States for international dangerous goods shipments by the marine mode.

The International Civil Aviation Organization (ICAO) has regulations that, together with operator requirements are included in the International Air Transport Association (IATA) Dangerous Goods Regulations. Both Canada and the United States use these regulations to ship dangerous goods by air, both domestically and internationally.

Compliance

Failure to comply with these requirements can result in various enforcement actions. These can include seizure of goods or means of containment or orders to take specific corrective actions. Upon conviction, penalties can include fines, compensation payments, prohibitions, mandatory payments into research funds, and even prison terms. In addition, an offense is a separate offense for every day that it occurs or every day that it continues. The costs of non-compliance are huge. We’re here to help you do it right.

Grandfather Clause 4 Non-Spec Diesel Tanks Expires


Since 2002 an amendment to the Clear Language Regulations has allowed diesel fuel to be transported in non-specification tanks. Starting January 1, 2010 it will be imperative that “skid” tanks and other non-spec tanks be standardized. The grandfather clause has run its 8 year course and with its expiry there should be little excuse for non-compliance. Depending upon the tank type used, there are Standards available indicating the proper tank specification to be used January 1, 2010.
