Grandfather Clause 4 Non-Spec Diesel Tanks Expires
Since 2002 an amendment to the Clear Language Regulations has allowed diesel fuel to be transported in non-specification tanks. Starting January 1, 2010 it will be imperative that “skid” tanks and other non-spec tanks be standardized. The grandfather clause has run its 8 year course and with its expiry there should be little excuse for non-compliance. Depending upon the tank type used, there are Standards available indicating the proper tank specification to be used January 1, 2010. Bill C-9 Passed

This “anti-terrorism” bill strengthens the security of storage and movement of certain dangerous goods. Persons whose job description includes the importing, handling, offering for transport or transporting dangerous goods will have to be issued security clearance by the Minister. For those who are unable or unwilling to take a background check will not be able to perform dangerous goods related tasks.

The regulation that will define certain dangerous goods has not yet been written. We can only assume that the definition will look at the concentration of the dangerous good, the size of shipment, and whether the end use of the product could include substances used for terrorism. Amendment 8 in the Works

Amendment 8 is in Gazette I. The biggest change will affect those who have been using the 150 kilogram exemption. In a nutshell, this ample exemption will become more restrictive, limiting Part 1.15 to those who transport purchased consumer available dangerous goods to home or place of use. Retailers will be able to transport those goods under this part, but couriers, trucking companies and others who consolidate loads will not be able to use this exemption any more. Transport Canada needed to make this change because there were many unidentifiable dangerous goods moving about our public streets. This change will help to increase public safety.

Update on HAZMAT Restrictions in China
We are passing along updated information from DOT concerning the situation on hazmat transport and production in China during the Olympic period. PHMSA notes the numerous and conflicting reports they have received to date and the agency is still working to sort out the details. In reviewing the DOT situation report, there does not appear to be any confirmed control requirements that will take effect June 1, as some reports have indicated. PHMSA references the list of 257 restricted chemicals that DGAC provided in an earlier message to members. We will send along DOT updates as we receive them.
